GCCF Lawsuit

If you have not been paid by the GCCF at this point, your best chance are probably to go with an attorney and file a GCCF Lawsuit. The only way to make GCCF pay your loss is to go the way of the courts.

So in this post I will try to explain the process as well as I know it. I am not an attorney so please talk to an attorney to get legal advice. I have talk to lots of people about the process including some of the attorney’s with the most cases in this GCCF litigation.

If you are with an consultant today and have been denied its time to fire the consultant and get with an attorney. The consultant can only take you so long in the process, after you have been denied by the GCCF the consultant can do no more for you.

GCCF Lawsuit Process

Its important to understand OPA (oil pollution act from 1990) to navigate the legal climate that will stand between you getting paid and you not getting paid. The OPA says that you have to present you claim to the GCCF first, if they have denied your case or offered you an amount that cannot be accepted by you, then you are free to go to the courts. If the GCCF has had your case for more than 90 days and there has been no response from them, you are again free to go to the courts.

They will take over your case and make it ready for trial. As this is a MDL (multi district litigation) your case will go back to the district where you live and be litigated there. So after the liability phase of the Oil Spill trial is over in February 2012 the MDL will start and your case will go on the court calender in your home district.

 

What will happen with my GCCF Lawsuit ?

First you would have to have an attorney and he would file a GCCF lawsuit with the courts, after he does that negotiations between the parties GCCF (Feinberg/Rozen) and your attorney will start. This process will most likely end in a settlement on something you can accept. The GCCF do not want to take any of these cases to trial as the media and future liability of any cases decided by the courts would hurt them when paying other GCCF claims out. So there is a very good chance that the GCCF will want to settle with your attorney on your case. If it does not settle the case will be put on the courts calender and a date for trial will be set. This will be a jury trial and your case will be gone though by your attorney (Plaintiff ) and the GCCF attorney (Defense) and the Jury will decide what kind of money you should be paid if any at all by the GCCF.

What will a GCCF Lawsuit Cost ?

The nice thing about our legal system is how attorney’s can do a contingency fee deal with a client so the client don’t have to pay until he gets money. So there are no upfront cost for you, the attorney will pay it all until you get money. If the case goes to trial you will pay 33 1/3 % of what you get as a minimum fee to your attorney. This might seem as a lot of money but you are not the one that takes the risk of going to trial and getting your GCCF claim paid. If the attorney losses it will cost you nothing. So the attorney is taking a lot of risk on his part and he wants that risk covered by the fee he charges a client.
